FLA Defends Private Property Rights in Hunting Lease Lawsuit

The Forest Landowners Association led an effort to support the rights of private forest landowners and preserve recreational opportunities on private forest lands by filing an Amici Curiae Brief in the case of Handberry vs. Stuckey Timberland, which received a favorable decision on March 14 by the Georgia Court of Appeals.

FLA supported this case because we believed there was a real danger that it could spur similar challenges in neighboring states, resulting in concerns related to recreation liability and landowner’s ability to lease land for supplemental income. Hunting and recreational leases provided millions of supplemental incomes to forest landowners as well as providing access to quality lands for the millions who take to the woods for recreational enjoyment every year.

“This is a win for all landowners! FLA embraced the opportunity to take the lead role in soliciting the Amicus brief and its supporters. I would like to thank FLA for their commitment and continuing support of vital private property rights," commented Wade Hall, President of Stuckey Timberland.

“Erosion of Private Property Rights is one of FLA’s guiding principles. We believe that human society cannot reap the numerous benefits of forests without secure private property rights. Not only do we state this, but we also support our members in defending their property rights. This was the case when Stucky Timberlands informed us about their lawsuit. We did not hesitate in filing an Amicus Brief and rallying support of others to join us,” stated Scott Jones, FLA CEO. FLA was joined on the brief by the Georgia Forestry Association, Southeastern Lumber Manufacturers Association, Georgia Agribusiness Council, Georgia Farm Bureau, Quality Deer Management Association and the Georgia Wildlife Federation.
