Clean Water Restoration Act

Changing the jurisdiction in the existing Clean Water Act (S. 787), the Clean Water Restoration Act would greatly expand the jurisdiction of the Clean Water Act to include all waters of the U.S. This would include any wet area in the U.S., including ditches, puddles and seasonal standing water. Such a change could subject private forest landowners to federal permitting requirements for forest management activities.

In the Senate, the Clean Water Restoration Act (S. 787-Feingold) recently passed the Environment and Public Works Committee by a 12-7 vote, despite opposition from FLA and many broad ranging organizations. FLA has been informed thta the bill will likely be voted on by the full Senate sometime this year; however it remains unclear when this will happen. There remains strong opposition to this bill in the Senate.

In the House, Rep. Oberstar (MN) has indicated that he intends to introduce the House version of the Clean Water Restoration Act later this year. Rep. Oberstar wants to push for a quick vote in the House before the end of the year.
