FLA Board vote Supports Legal Remedy for Forest Roads

The FLA Board of Directors voted unanimously to lend FLA’s name to an amicus brief being filed by the Pacific Legal Foundation (PLF) concerning the silvicultural exemption of forest roads in the Clean Water Act.

These amicus briefs are crucial components of the strategy to obtain U.S. Supreme Court review of the 9th Circuit decision to require permitting for forest roads. Currently 4 briefs are being filed and each brief will address different aspects of the Court’s decision. The Pacific Legal Foundation brief will cover critical arguments in addition to the legal/jurisdictional issues set forth in the petition and will provide specific examples of possible harm throughout the country from the Court’s actions.

Those filing amicus briefs include: the Arkansas Attorney General (other state attorneys general will be asked to sign onto this brief); the National Alliance of Forest Owners (NAFO), which will focus on legal issues related to overturning a 35-year old regulation; the American Forest Resource Council, which will focus on the effects of the decision on access to federal lands; and the Pacific Legal Foundation, which will focus on the economic effects of the decision, including the effects on jobs, the forest products industry and local economies. All briefs must be filed by October 14, 2011.
