In April, the House Judiciary Subcommittee on the Constitution and Civil Justice held a hearing on the Private Property Rights Protection Act in preparation of introducing legislation in the 113th Congress to prevent the taking of private property for the prosperity of individuals and private businesses. Similar legislation was introduced by Rep. James Sensenbrenner, Jr. (R-WI5) in the last session of Congress and was passed by the House but never passed by the Senate.

A draft bill of the Private Property Rights Act, expected to be introduced by Rep. Sensenbrenner in the coming weeks, released by the subcommittee states, "The Federal Government or any authority of the Federal Government shall not exercise its power of eminent domain to be used for economic development.” The bill also recognizes that "rural lands are unique in that they are not traditionally considered high tax revenue-generating properties for State and local governments. In addition, farmland and forest land owners need to have long-term certainty regarding their property rights in order to make the investment decisions to commit land to these uses.”

Our Position

FLA is an ardent supporter of private property rights and believes that local, state, federal and non-governmental organizations are increasingly imposing restrictions and regulations that threaten the sustainability of private forests. Any efforts to restrict or encumber private forestlands without fair compensation will be opposed by the FLA. We believe landowners should be compensated for land use restrictions, partial takings as well as full takings as provided for in the 5th Amendment of the Constitution.
