Forest Roads Update

In previous e-newsletters, we have alerted you to a critical issue with the potential to affect the entire forest products industry—forest roads permitting.

This decision seriously threatens the economic and environmental viability of private forests.  Mandatory permits will result in additional paperwork and compliance requirements, project delays, and, for the first time, the ongoing threat of special interest lawsuits under the Clean Water Act. 

As we have reported, legislation has been introduced in the House and Senate, The Silvicultural Regulatory Consistency Act. Along with this legislative route, parties to the original suit in the 9th Circuit Court of Appeals are filing a Supreme Court challenge. 

The Forest Landowners Association (FLA) is closely following both the Supreme Court challenge and has partnered with the National Alliance of Forest Owners (NAFO) in pursuit of a successful legislative remedy to this potentially nationwide regulatory burden.

Last week, in a sign of support from the FLA membership, the leadership of FLA approved a $10,000 contribution to a campaign aimed at restoring the historic treatment of forest roads as nonpoint sources that do not require federal permits.  FLA will continue to support the resolution of this issue through our representation in Washington DC and providing financial resources when and where necessary.  Please continue to follow our updates as they develop on this issue so you can be prepared to act if called upon.
